Terms of Service

1. Acceptance of Terms

By accessing or using Stalkly (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. If you access the Service on behalf of a Discord server or organization, you confirm that you have the authority to bind that server or organization to these Terms.

2. Description of Service

Stalkly is a community analytics platform for Discord servers. A server owner or administrator adds our bot to their own server, accepts these Terms through Discord's official OAuth login, and switches tracking on; Stalkly then provides that server with statistics on message and voice activity, member growth, activity timing, role distribution and member leaderboards, plus optional notifications and reports. Stalkly collects nothing from a server that has not been enabled this way. The Service is provided “as is,” and we may add, change or remove features at any time.

3. Eligibility

You must be able to form a binding contract to use Stalkly and meet the minimum age required by Discord's own Terms of Service in your country. If you switch tracking on for a Discord server, you represent that you hold the Manage Server permission or own the server, and that you are authorized to do so under that server's own rules.

4. Your Account

Your Stalkly account is tied to your Discord account through Discord's official login (OAuth). You are responsible for activity that occurs through your account and for keeping your Discord account secure, since access to it controls access to Stalkly.

5. Acceptable Use

• Do not use the Service to harass, stalk, threaten, or endanger any person.
• Do not use the Service to track, monitor or profile an individual person, or to build any record about a person beyond the analytics the Service is designed to show.
• Do not use the Service to work around another user's or another server's privacy settings.
• Do not use the Service to violate any person's legal rights, including privacy and data protection rights.
• Do not attempt to circumvent, disable, or interfere with the Service's security or access controls.
• Do not use the Service in a way that violates Discord's Terms of Service, Community Guidelines, or Developer Policy.
• Do not scrape, bulk-export or redistribute the statistics the Service produces as a dataset, and do not resell or sublicense the Service or use it to build a competing product without our written permission.

6. Data Collection and Scope

Your use of Stalkly is governed by our Privacy Policy, which explains what we collect, why, how long we keep it, and how to control or delete it. Stalkly processes data only for Discord servers whose owner or administrator has enabled it, and only through Discord's official bot, OAuth and gateway interfaces. We have no access to direct messages, and we collect nothing from servers our bot has not been invited to. Any member of an enabled server can hide their profile, opt out of presence collection, or request deletion of their data at no cost from the Privacy Center.

7. Discord Platform Compliance

Stalkly connects to the Discord platform through Discord's official APIs and is subject to Discord's Terms of Service, Developer Terms of Service, Developer Policy and API rules. Where those rules conflict with these Terms, Discord's rules prevail. They may change at any time and are outside our control, and we may have to modify or discontinue features to stay compliant with them. Stalkly is not affiliated with, sponsored by, or endorsed by Discord Inc.

8. Subscriptions and Payments

Some features are offered as paid subscriptions or one-time purchases (“Premium”), billed through PayPal. Depending on your billing country, a plan may renew automatically or be charged as a single payment; the checkout page always shows which applies before you pay. Privacy controls are never sold: hiding your profile, opting out of presence collection, and requesting deletion are free for everyone. Prices, currencies, and available plans may change; changes will not retroactively affect a period you have already paid for. Except where required by law, payments are non-refundable.

9. Intellectual Property

The Stalkly name, logo, interface, and underlying software are our property or that of our licensors and are protected by applicable intellectual property laws; nothing in these Terms transfers that property to you. Data we receive from Discord is not ours: it remains Discord platform data, subject to Discord's Terms of Service and Developer Policy, and we hold it only as described in our Privacy Policy. The aggregate statistics we compute are provided for your use inside the Service and may not be redistributed as a dataset.

10. Disclaimers and Limitation of Liability

The Service is provided without warranties of any kind, express or implied, including as to the accuracy or completeness of any statistics. To the maximum extent permitted by law, Stalkly is not liable for indirect, incidental, or consequential damages arising from your use of, or inability to use, the Service.

11. Termination

We may suspend or terminate access to the Service, for any account or Discord server, at our discretion, including for conduct that violates these Terms, Discord's rules, or that we reasonably believe is harmful to other users or to the Service. You may stop using the Service at any time by switching tracking off, removing the bot, or revoking Stalkly's access from your Discord account settings.

12. Governing Law

These Terms are governed by the laws applicable to our operations, without regard to conflict-of-law principles, except where local law grants you rights that cannot be waived by contract.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by updating the “Last updated” date. Continuing to use the Service after changes take effect means you accept the revised Terms.
